These terms and conditions apply to the pika pick app (hereby referred to as “Application”) for mobile devices that was created by Ochotona Studio (hereby referred to as “Service Provider”) as a Freemium service.

Upon downloading or utilizing the Application, you are automatically agreeing to the following terms. It is strongly advised that you thoroughly read and understand these terms prior to using the Application.

Intellectual Property Rights

Unauthorized copying, modification of the Application, any part of the Application, or our trademarks is strictly prohibited. Any attempts to extract the source code of the Application, translate the Application into other languages, or create derivative versions are not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider.

Service Modifications and Fees

The Service Provider is dedicated to ensuring that the Application is as beneficial and efficient as possible. As such, they reserve the right to modify the Application or charge for services at any time. Any paid features or charges will be clearly communicated to you and require your consent through the applicable app store billing system.

Account and Local Data

The Application does not require login or account registration. Some app data, such as saved events, saved places, or preferences, may be stored locally on your device. The Service Provider is not responsible for loss of local data caused by device failure, app deletion, operating system changes, or user action.

Location-Based Features

The Application may use location information, with your permission, to show nearby cultural events, places, and distance information. The accuracy and availability of location-based results may vary depending on device settings, network conditions, third-party data sources, and local service availability.

The Application may utilize third-party services that have their own Terms and Conditions:

Connectivity and Data Usage

Some features of the Application, including event information updates, maps, location-based recommendations, and advertisements, may require an active internet connection. The Service Provider is not responsible for any data charges incurred from your mobile provider while using the Application, nor for limited functionality due to lack of internet access.

Limitation of Liability

The Service Provider strives to provide useful and accurate cultural event and place information. However, event schedules, venue details, operating hours, availability, fees, and other information may change without notice. The Application is provided “AS IS”, and the Service Provider accepts no liability for any loss, direct or indirect, resulting from your reliance on information shown in the Application.

Updates and Termination

The Service Provider may update the Application to maintain compatibility with operating system changes, improve reliability, or add new features. You agree to accept updates when offered. The Service Provider may also cease providing the Application at any time without prior notice. Upon termination, all rights and licenses granted to you will end, and you must cease using the Application.

Changes to These Terms

The Service Provider may periodically update these Terms and Conditions. You are advised to review this page regularly for any changes.
